Michigan’s New Booster Seat Requirement for Children

As of July 1, 2008, all children under 4 feet 9 inches tall and below the age of eight years old must be seated in vehicles using a booster seat. Thia law adds to the preexisting child restraint system requirement for those under the age of four years old. Michigan is the 39th state to enact such a law with child safety in mind. Although approximately 58% of children in this age range are already using booster seats, analysis shows enactment of a targeted law will increase usage and safety.

With the use of a booster seat, the vehicle safety of those under the age of eight will improve dramatically. Seatbelts without booster seats make children four times more likely to suffer an injury during an automobile accident.

Failure to comply with this law will result in a civil infraction (a fine). This new booster law will not apply to your children when they ride the bus to school. For the text of the legislation, click here.
